Why do you need a will?
If you do not have a will, the law determines what happens to your assets.
Normally up to £250,000 passes to your spouse. Anything above this amount is divided equally among your children. If you do not have children the law determines who receives your assets. This can leave out people you would otherwise wish to provide for. A will is especially important if you have children under the age of 18 because you can nominate a guardian to take your place in the event of your untimely death. If no provision is made for guardianship and both parents die, the court will decide who looks after any surviving children. A will also enables you to set up trusts to hold assets for young children until they reach the age of 18. Finally, it lets you determine what happens to your body after you die.
Your will is the legal expression of your final wishes.
